Medtech Association Advances Ethics and Regulation in Medical Technology Sector

The Medtech Association, a leading voice in the medical technology industry, continues to shape the sector with its commitment to ethical business conduct and regulatory advocacy.

In a significant move, the Medtech Association has asked the US District Court for the District of Massachusetts to rule as a matter of law that independent sales agent (ISA) arrangements do not violate the Anti-Kickback Statute (AKS). This action underscores the organisation's focus on ensuring fair and transparent business practices.

The Medtech Association has also taken a proactive stance on federal privacy laws. On May 30, 2025, it called for laws that reflect how medical devices use patient data differently from consumer health tools.

In the realm of regulation, the Medtech Association submitted public comments in response to HHS's request for information on eliminating federal regulations. This move demonstrates the organisation's commitment to streamlining regulations while maintaining patient safety and responsible innovation.

The Medtech Association has been instrumental in the APEC Business Ethics for SMEs Initiative since its inception in 2010. This initiative, which it founded along with partners, has extended high-standard codes to over 12,000 member enterprises across 19 economies in the APEC region.

The Medtech Association's advocacy extends to regulatory matters as well. It commented on the OMB Deregulation RFI, expressing concerns about tariffs affecting U.S. medtech innovation, jobs, and patient care.

In terms of public engagement, the Medtech Association launched 'The Story of Medtech,' a platform for patients to share their experiences with medical technology.

The organisation has also published reports on the Medical Device Mass Tort TV Ad Trend for Q1 and Q2 2025, providing insights into advertising trends in the industry.

Notably, the Medtech Association is working towards updating the APEC Kuala Lumpur Principles in 2026. This collective effort aims to further strengthen business ethics in the medical technology sector.

The updated Code of Ethics, which will be released by the Medtech Association in 2025, reaffirms the industry's commitment to patient safety, responsible innovation, and data stewardship.

The organisation AdvaMed also participated in the Asia-Pacific Economic Cooperation Business Ethics for SMEs Forum held in Seoul, Korea, in September 2025 and supported an initiative to promote high standards in business ethics for the medical technology industry.
