Elderly housing Wallberg: decision on location still pending
In the picturesque town of Rottach-Egern, Germany, the future of the Senior Residence Wallberg remains uncertain as a legal challenge against its construction continues.
The town council has been deliberating alternative ideas for the residence's future operating concept in a non-public meeting. The ongoing legal battle stems from opponents filing lawsuits, expressing concerns about the project's environmental impact and compliance with local planning regulations.
As of now, a formal trial date has yet to be scheduled publicly. Such planning-related legal disputes in Germany can take several months to over a year before a hearing is set, depending on the court's schedule and any interim measures or additional expert assessments required.
Recently, the Administrative Court of Appeal (VGH) conducted an on-site inspection of the property. This visual inspection was a private meeting between representatives from the municipality of Rottach-Egern, the plaintiff's lawyers, and the court. To date, no decision has been made.
The purpose of the on-site inspection was to verify whether the local circumstances were accurately represented in the procedure for drawing up the building plan and in the plan itself. It's worth noting that the municipality does not favour the construction of detached houses on the idyllic property near the Weißachau.
Carestone, a company from Hannover, plans to demolish and rebuild the Rottach Senior Residence Wallberg. They acquired the senior residence from the heirs of the former owner Peter Wisgott at the beginning of 2021. Auvictum Group from Hanau has been confirmed as the facility's operator.
The new construction will be a complex with three four-story buildings, accommodating a senior home with a total of 156 rooms. Day care and outpatient care are also topics under discussion for the residence's future operating concept.
A resident is challenging the new construction with a norm control lawsuit. The company spokesman, Stefan Schlichting, mentioned "careful testing processes in close coordination with the municipality and public authorities."
For the most precise and updated status—including any recently set trial dates—it is advisable to consult the local administrative court handling the case or check official announcements from the Rottach-Egern municipality or the involved parties. No new updates regarding a trial date have been provided as of yet. The municipality remains committed to the principle of keeping the senior facility on site.
